FIRE Files Brief With Supreme Court in ‘Susan B. Anthony List v. Driehaus’ - FIRE
Yesterday, FIRE filed an amicus curiae (“friend of the court”) brief (PDF) with the Supreme Court of the United States in the case of Susan B. Anthony List v. Driehaus. The case, which arrives at the Court on appeal from the United States Court of Appeals for the Sixth Circuit, involves a constitutional challenge to an Ohio law prohibiting “false statements” in electoral campaigns. FIRE’s brief argues that the Sixth Circuit erred in dismissing a First Amendment challenge to the law and warns that if the ruling is allowed to stand, college students and faculty whose speech is chilled by overly broad and vague speech codes will be denied the opportunity to seek judicial relief. We’ll have more analysis of the case and FIRE’s brief tomorrow.
