would 90% of discourse about public sex disappear if everyone understood that “public sex” does not mean “sex in front of other people”? i feel like everyone who thinks public sex should stay illegal are either
1. people who are misinformed about what “public” means, legally
2. conservatives who are intentionally criminalizing sex workers, houseless people, and generally anyone who does not have the privacy and safety afforded to those in the property owning class
things that are considered “public sex” that do not include being in front of anyone
- sex or masturbation while camping
- sex or masturbation in a car
- sex or masturbation out in nature, even in a secluded place
- sex or masturbation in one’s vehicle-home if parked in a parking lot
- sex or masturbation in hotel rooms
- sex or masturbation in a bathroom stall in a club that cards at the door so everyone is 21+ & no one else is there in the bathroom
- sex or masturbation in a secluded part of a park in the middle of the night when no one is around
- sex or masturbation literally anywhere that is not a private residence
the idea of sex or masturbation intentionally in front of unconsenting people is already counted under sexual harassment and in some cases sexual assault. This form of sexual abuse can also happen on private property the harasser owns and it’s just as bad, because sexual violence is inherently bad wherever it takes place.
“public sex” is not criminalized because someone can sexually assault someone in public spaces and consensual sex gets caught in the legislative crossfire– “public sex” is criminalized because it is one of the many, many ways to criminalize poverty, homelessness, sex work, & lgbtq people
