Hi, Tumblr. It’s Tumblr. We’re working on some things that we want to share with you. 

AI companies are acquiring content across the internet for a variety of purposes in all sorts of ways. There are currently very few regulations giving individuals control over how their content is used by AI platforms. Proposed regulations around the world, like the European Union’s AI Act, would give individuals more control over whether and how their content is utilized by this emerging technology. We support this right regardless of geographic location, so we’re releasing a toggle to opt out of sharing content from your public blogs with third parties, including AI platforms that use this content for model training. We’re also working with partners to ensure you have as much control as possible regarding what content is used.

Here are the important details:

  • We already discourage AI crawlers from gathering content from Tumblr and will continue to do so, save for those with which we partner. 
  • We want to represent all of you on Tumblr and ensure that protections are in place for how your content is used. We are committed to making sure our partners respect those decisions.
  • To opt out of sharing your public blogs’ content with third parties, visit each of your public blogs’ blog settings via the web interface and toggle on the “Prevent third-party sharing” option. 
  • For instructions on how to opt out using the latest version of the app, please visit this Help Center doc. 
  • Please note: If you’ve already chosen to discourage search crawling of your blog in your settings, we’ve automatically enabled the “Prevent third-party sharing” option.

A message from a few of the trans staff at Tumblr & Automattic:

We want trans people, and LGBTQ+ people broadly, to feel welcome on Tumblr, in part because we as trans people at Tumblr and Automattic want it to be a space where we ourselves feel included. We want to feel like this is a platform that supports us and fights for our safety. Tumblr is made brighter and more vibrant by your presence, and the LGBTQ+ folks who help run it are fighting all the time for this, for you, internally. 

A few days ago, Matt Mullenweg (the CEO of Automattic, Tumblr’s parent company) responded to a user’s ask about an account suspension in a way that negatively affected Tumblr’s LGBTQ+ community. We believe that Matt's response to this ask and his continued commentary has been unwarranted and harmful. Tumblr staff do not comment on moderation decisions as a matter of policy for a variety of reasons—including the privacy of those involved, and the practicalities of moderating thousands of reports a day. The downside of this policy is that it is very easy for rumors and incorrect information about actions taken by our Trust & Safety team to spread unchecked. Given this, we want to clarify a few different pieces of this situation:

  • The reality of predstrogen's suspension was not accurately conveyed, and made it seem like we were reaching for opportunities to ban trans feminine people on the platform. This is not the case. The example comment shared in the post linked above does not meet our definition of a realistic threat of violence, and was not the deciding factor in the account suspension.
  • Matt thereafter failed to recognize the harm to the community as a result of this suspension. Matt does not speak on behalf of the LGBTQ+ people who help run Tumblr or Automattic, and we were not consulted in the construction of a response to these events.
  • Last year, the "mature" and "sexual themes" community labels were erroneously applied to some users' posts. An outside team of contractors tasked with applying community labels to posts were responsible for this larger trend of mislabeling trans-related content. When our Trust & Safety team discovered this issue (thanks largely to reports from the community), we removed the contracted team’s ability to apply community labels and added more oversight to ensure it does not happen again. In the Staff post about this, LGBTQ+ staff pushed to be more transparent but were overruled by leadership. The termination of a contractor mentioned in the original ask response was for an unrelated incident which was incorrectly attributed to this case. We regret that the mislabeling ever happened, and the negative impact it has had on the trans community on Tumblr. 
  • Transition timelines are not against our community guidelines, and weren’t a factor considered by the moderation team when discussing suspensions and subsequent appeals. We do not take action against content that is related to transitioning or trans bodies unless it includes violations of the Community Guidelines.
  • When it comes to the experience of trans folks on Tumblr encountering transphobic content, and interacting with bigoted users, we understand and share your frustrations. Tumblr’s policies, and Automattic’s policies, are written to ensure freedom of speech and expression. We prohibit harassment as defined in our Community Guidelines, but we know that this policy falls short of protecting users from the wider scope of harmful speech often used against LGBTQ+ and other marginalized people.
  • Going forward, Tumblr is taking the following actions:
  • Prioritizing anti-harassment features that will empower users to more effectively protect themselves from harassment.
  • Building more internal tooling for us as Staff to proactively identify and mitigate instances of harassment.
  • Reviewing which of the tags frequently used by the trans community are blocked, and working to make them available next week.

We’re sorry for how this all transpired, and we’re actively fighting to make our voices heard more and prevent something like this from happening again in the future. We know firsthand that having to deal with situations like this as a Tumblr user is difficult, particularly as a member of an already frequently targeted and harassed community. We know it will take time to regain your trust, and we’re going to put in the work to rebuild it.

We appreciate the space we have been given to express our concerns and dissent, and we are thankful that Matt’s (and Automattic’s) strong commitment to freedom of expression has facilitated it.

We will continue to fight to make Tumblr safe for us all.

now is a good time to be listening to our black sisters, our jewish sisters, our asian sisters, our polynesian sisters, our latina sisters...we cant let the "first they came for the [x]" continue.

this shit has been happening especially to those who protest the injustices done to their people prior to this major incident, and now that we have all but confirmation that these designs are on purpose and working as the architects intended then we cannot disregard each time it continues to happen to one of us. especially for our POC sisters, and especially for our black sisters that get punished for daring to protest a system that all but wants them dead and out of the way. that shit has gone on for too long

we need to learn not just from the mistakes but the intentional cruelties and mismanagement of these systems and work together to improve things for everyone. all power to all people

lets all be REAL clear here avery was banned because a TERF harrassment campaign was successful, the ex post facto excuse of "death threats" was and i cannot stress this enough a transparent attempt from a corperate management system to Hide and Deflect from the fact that there was, is, and it seems will Remain, a HUGE gaping flaw in their moderation. an Excuse from a CEO who knows that, if he admits there IS a problem, then he and his company are Legally On The Hook for YEARS of discrimination.

THIS IS POTENTIALLY ACTIONABLE (for users in the EU)

Tumblr has already proven it cannot uphold it's responsibilities under the EU Data Services Act (DSA). Failure to adequately moderate their site, including with regards to competently handling both bans and user complaints, is a direct and continuous violation of the DSA.

Under the DSA, EU users have a right to complain to the service (i.e. Tumblr). They should do this first and without delay.

Some examples of violations that you should report include:

  • lack of transparency (this includes lying about ToS violations, by the way) about bans and removed content
  • lack of appropriate redress following bans and removed content (unfairly banned for life with no chance of reinstatement? you should file a complaint)
  • illegal content (I point you to the CEO's multiplatform campaign of harassment, and invite you to complain to Twitter too - they have even stricter obligations as a larger company)
  • failure to address user complaints (have you registered a complained to Tumblr about the above, or about harassment you've received, or about any other valid matter in the past 6 months? has nothing been done? that's an actionable DSA violation; see below)

If EU users do not believe their complaint to the service provider has been adequately resolved, they have the right to report DSA violations to their relevant authority.

🇮🇪 Information for citizens of the Republic of Ireland below the cut:

here is the list of where to go to report DSA violations for each EU member state. it took me a while to find, possibly because the policy only fairly recently went into effect.

note that the DSA only went into effect on 17 february 2024 for all websites save a small handful of the absolute largest ones (which tumblr doesn't fall under). I'm not sure whether the european commission can or will act on violations that happened before that date, but everything that happened after the 17th (including the horrible way they treated avery) absolutely can and should be reported

What is this about the tumblr staff wanting to sell art data to midjourney?

An ex-colleague of mine mentioned yesterday that there may be contacts between Automattic and midjourney in that direction, but nothing is public yet and I don't have any more info. They probably won't have anything specific to share either, since they left the company weeks ago too. That being said:

  • I have no reason to doubt my ex-coworker word, they are a trustworthy person.
  • Tumblr's CEO has been absurdly enthusiastic (comically, even) about AI, and is a big fan of LLMs and 'AI' companies.
  • A deal with midjourney could solve tumblr financial issues (not the same company, but openAi is paying up to 5 million/year to news companies to use their content as training data... tumblr generates several orders of magnitude more content than any newspaper or any media company and it only would need a 20 to 30 million per year deal to be profitable)

So I don't have any extra info yet, but I'm keeping my ears open.

And I just got confirmation from a second ex-colleague that a deal with midjourney has been brewing since months ago. Not any extra details, just that's a real thing.

Shit, I don't see any way for this to happen that doesn't make it an apocalyptic event the size of the porn ban. Fuck.

Shit. This may be pure chance and coincidence, and it's not he is in a position to be able to talk about anything, but seeing prominent staff members announcing they are moving their original photography out of tumblr just two weeks ago seems a pretty significant cue of shit to be about to hit the fan.

ok here's the thing. he is meant to be on sabbatical. automattic gives employees a three-month paid sabbatical every 5 years, so that they can have a break from the product they work on and come back rested and with a new perspective.

matt has never taken one before now. he spent the entire leadup to his sabbatical posting increasingly wild shit in public channels at the company (like the chess thing, or trying to get people to buy a friend's product, or the entire fracas with taking over the wordpress.org twitter account. wordpress.org is an independent non-profit that he is not the ceo of).

i mention this because people were hoping (including me) that he really would actually log off, have a chill time (or, idk, whatever kind of time CEOs who go off the grid bc they got flooded in at burning man like to have), and let the interim CEO get a chance to do a better job. that would help the board make a decision based on data.

he was very clearly spiraling before he even left, and then within the first few days of Company Sanctioned Log Off Time he's pulled multiple Classic Matt things on multiple parts of the company before showing up here. this whole thing is so deeply unfunny but it also is a bit of a tom and jerry or looney tunes bit, where i can only imagine HR or Legal is chasing him around the various accounts/platforms with a comically large inflatable baseball bat and he's just evading them.

he can't do that in person, but he still gets a lot of leeway generally. at the last division meetup (irl meeting for employees, flown from all over the world) he showed up twitchy and exhausted and hyped in a way that was very familiar to me from flatmates who used to steal and snort my adhd medication, then proceeded to drink so much over the course of an evening answering questions from his employees that he had to be firmly babysat off the stage and walked back into the lobby of the hotel to sober up.

i made eye contact with him that night, before he dropped his head back into his hands. two people relatively high up in the company were sitting with him, silently watching him as he struggled to sober up. it wasn't the first drunk shenanigan of his i witnessed at one of these, and this is purely opinion but i have to assume that his current behavior is the result of suddenly having time on his hands to have the world's longest bender and post through it.

back to your question: i do not know if what he's done is enough to get the board to remove him. i wish it didn't have to come to this to hope that they will. but we'll find out.

But for nearly a calendar year, I picked up the tab every chance I got, i lavished people with gifts, I took a friend to Greece, I paid for healthcare for myself and a few other people, for lawyers to help someone get out of an abusive marriage, Christmas presents for a single mom of 3.

It felt incredible. Just to take away the worry and say, "I've got you." Instacart groceries to a grieving friend of a friend across town. Pay the unexpected car repairs. Gift a young artist a yearlong subscription to Procreate.

That's why I'll never understand billionaires. If you could fix it, if money could actually make even one life better, why would you not do it? Even just for the kick? Hell, i don't care if it feeds your ego. Be Tony Stark, be Superman, idgaf. When you'll never be able to spend all that you have, even if you some up every damn day like it was your job, if you could end world hunger six times over for the price of a social media company, why wouldn't you just DO IT?

I don't have a coherent conclusion to this, except that if I ever meet Jeff Bezos, I'll beat him to death with my bare fists.

CEO of Tumblr, Matt Mullenweg, has started openly harassing tumblr users on other platforms. This dude is actually incredibly scary and malicious and should not be involved with this website going forward. Theres just no excuse for this behavior.

trans women deserve better. we are barely shown basic fucking decency irl online it doesnt matter where we are. it doesnt matter if we even move to a different website and it doesnt matter if people have to break data protection laws along the way - transmisogynists will stop at nothing to degrade and humiliate trans women to justify their abuse and convince you that "he- i mean it- i mean they deserved it".

please stand up for the trans women in your life because it did not start and certainly will not end with predstrogen.
