Heard learned counsel for the petitioners and the State.

Submission of the learned counsel for the petitioners is that though allegation has been levelled for demand and torture for its non-fulfilment but petitioners are parents of the complainant’s husband who had not been made accused in the case. Allegation has been levelled only to pressurize them for handing over maximum amount of retiral benefit received after retirement of petitioner no.1. Certainly this aspect for false implication misusing the penal provision of 498A shall be considered at the conclusion of trial for fixing liability upon the complainant. Accordingly, this petition for anticipatory bail is allowed. In case of arrest or surrender within one month from the date of receipt/production of a copy of this order in Complaint Case No.1626 of 2008, the above named petitioners shall be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand)each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sasaram, Rohtas, subject to the conditions as laid down under sub- section (2) of Section 438 of the Code of Criminal Procedure.
