Okay, you get an answer, because at least you took the effort to write your ask out properly, even if you are hiding behind the grey, sunglassed circle.

Do I, or any fanfic author for that matter, have any legal claims to our work? No, not really, no. (Although if someone took a fic, filed off the serial number--deleted the fandom specific elements--, and then had it published for financial gain, yeah, that would be a case.)

BUT

Fandoms are built on a social contract that says we respect each others work, the effort people put into their art. We don't steal or disrespect the work of our peers. By feeding people's fanworks to AI you both steal and disprect it, and we need to make people realize that before it's too late--before fandom falls apart, because there will be no more real, actual fanworks.

Also this is not true. You do in fact have the copyright to the specific writing you did in a fic, because that's not how copyright law works. Like this is not a grey area.

People who write IP content for corporations give up their copyright on a contractual basis--the company wants writing they can sell about characters/settings they own without getting entangled in royalty obligations etc, so they hire people. Who sign contracts saying they don't own what they write as part of that job.

That's why you don't own Star Wars stuff you wrote for Disney; you specifically agreed not to own it.

Writing for IP you don't own leaves you in a position where you can't legally monetize it (without taking out the Owned parts ad rebranding), but it absolutely does not automatically cede or void copyright. That is super not a thing.

SUPER not a thing, I cannot say this enough.

I can't sell my Batman fic, but neither can DC Comics without my duly authorized consent. Because they own Batman, but not the prose I composed about him.

Do not perform that kind of massive corporate overreach for them. Holy shit. Do they not own enough.

It’s fascinating that this misconception of copyright still exists. Haven’t we all seen the posts on here where authors beg fans to please not send them fanfic of their works? They’re not doing that because they feel like it, they do that because fans legally own their words and ideas, and an author who takes them even unintentionally can in fact end up in real legal trouble for taking something that’s not theirs. It doesn’t matter whether they own the canon.

Copyright is the most basic of protections for all writers. If there’s anything professional/career writers want spread around, it’s the knowledge that all writers have the same protections that copyright confers on us.

The absolute contempt some types of people have for fanfic and fanfic writers is embarrassing. 

its the same for other arts as well. If I draw a picture of Big Ben I own the rights to that picture. Not Ben's og designer. If I sculpt a miniature of the Eiffel tower the french can't break into my house and demand monetary compensation for that. If I etch nude Drarry into a 45ft stretch of glass and write LGBT+ rights over it with a flag our dear friend Jk can't do shit about it.

Your Etsy shop selling unauthorized merch is not covered by copyright. Unless its parody or greatly changed the source material. This can become a bit of a gray area though. (Mattel vs Aqua is a great example. Love this case. One of my faves)

Copyright law is fascinating and the history of how the mouse changed it (for -arguably- the worse) is crazy. And one of my main beefs with Disney as a corporation.

You own the rights to what you make. The og Creator owns the rights to the source material and liscensing. You 'can't' make money off of others ideas, just as they 'cant' make money off of yours.

Ok, but if you’re an independent contractor in the US and this happens? Find a lawyer, because you might have just gotten a huge payday.

Your position was just referred to as employment. Independent contractors do not have employers; they do not have employment. Congrats, your contact at this company just provided evidence that you were illegally missclassified.

This contact is claiming that you have set hours you’re obligated to fulfill. Unless a work task can only be done at a set time for practical reasons (i.e. you’re an audio freelancer paid to support a live event that occurs at a particular time and requires a certain amount of pre-show setup), a company cannot set an independent contractor’s work hours. This is further evidence that you were missclassified.

The whole exchange establishes that the company is interpreting an employer-employee relationship rather than expecting a service. Discipline and potential for firing (you cannot fire an independent contractor; no longer purchasing their service is not equivalent) establish that this person views themselves as a manager. Independent contractors cannot have managers.

This one text exchange could:

  • Get you back pay for the full duration you’ve worked there, to bring you up to the compensation that an employee would have gotten
  • Get you back compensation for lost benefits that an employee would have gotten
  • Get you back pay for the additional self-employment taxes the company should have covered
  • Get the company to pay back taxes to the government
  • Get the company to hire everyone who performed a similar role, or face further penalties and fines
  • A win would encourage the rest of their missclassified workers to sue for the same, or give them leverage to demand a better deal

If the company is going to screw you over like that, may as well make them pay for it.

You can also file a form with the IRS to force the company to correct your classification (assuming you meet the criteria), without necessarily having to sue:

Keep in mind that this is just federal. Most states also prohibit missclassification as an independent contractor; and even if states have more lenient rules, companies still have to comply with this federal law. The rules have largely been bipartisan and existed for decades, so they’re common.

States also have an interest in having regulations about missclassification: it’s a significant loss of tax revenue. Your self employment tax does not fully equal what a company would have paid for you in payroll taxes.

A lawyer can help point you in the right direction if a company is currently missclassifying you.

Into reports of the sudden and wonderful blossoming of the #CisWithTheT twitter hashtag in Britain.

Some say it was a toxic BBC article spreading TERF lies that created the uproar, while others point to the  Dave Chappelle tragedy.

Regardless, suddenly a lot of cis people had had enough of the transphobia and came out in strong support of trans people.

I know a ton of people have said this before but for the love everything PLEASE stop treating AO3 like instagram. It is NOT cringe to comment on an old story. It’s an archive old stories are still meant to be found and read. Please think about interacting with the fic you read: at least kudos if you read it, a comment would be ideal. The authors will be over the moon. I guarantee you not a single author is going to ask why someone is commenting on an older fic.

I LIVE for my morning "You've got kudos" email. I have to fan myself if there's a comment.

Hey. Minors following me. Internet safety is key!! NEVER include these in your bio/byf:

  • Medical diagnoses - this is nobody's business but yours. You don't owe anyone an explanation for why you are the way that you are
  • Trauma - same reason as above
  • Triggers - people can use these against you! Don't give people tools to hurt you. No one has to know what tags you block. Just block tags to stay safe!
  • Age - age is okay for adults to include but is iffy when you're a teen. Predators want this information, don't give people more than they need. Just state that you're a minor, that's all that anyone needs to know.

In general: stay safe. If you're not comfortable with every stranger out there having access to this information, you shouldn't post it on the internet.

Play devil's advocate and ask yourself about what would happen if someone searched for your information with intent to hurt you. You do NOT owe anyone an explanation!

adding on to this post, i agree w all of OPs points, but i also highly advise against super young teens posting their face on the internet, its so easy to take peoples selfies + name and find stuff out like your school and then figure out the rough area in which you live. same with your phone number. be super careful about what you put out there. once you post it, it really is here forever.

OP already said this so I’m just reiterating to emphasize:

The golden rule of information sharing on the internet is: What would happen if someone saw this who wanted to hurt me?

If the answer is that it would make it easier to harass you, identify you, contact you, or god forbid find you, don’t put it online. You can’t fully control who does and does not see that information--not even with privacy settings.

I will never not reblog these things.

I’ve been on the Internet longer than any minor has been alive. I rode the ragged edge with the information I disclosed and somehow escaped unharmed. In today’s world, I may well not have.

If you have kids, don’t lose them. Stay involved in their world. They want you to, even if they act like they don’t. Your teenagers don’t need the legwork they once did, but they need a lot of mind-and-heart work. Hold onto them. My parents held onto me even when I fought them, and I think it’s one of the reasons I didn’t get in some of the trouble other kids did/do.

Tangential: I would like to see a movement away from putting diagnoses/triggers/traumas in bios. I think of my bio as what I’d lead with introducing myself. I wouldn’t say “I have XYZ diagnoses, ABC traumas, and these triggers.” Of course these things might come up in a conversation and that’s fine! But it’s not the first thing I’d tell a new person. I think my medical history and bad experiences are some of the least interesting things about me, really.

If you can’t find a place on your blog for Patrick Stewart in a bathtub dressed like a lobster, then your blog probably doesn’t deserve such majesty anyway.
