Short survey for nonbinary people about NAMES

Genuinely asking: do you ONLY want people who currently 100% identify as non-binary to participate? Is it okay for me, an Indigenous person that identifies with cultural genders to participate even if I no longer use/currently reject the term non-binary? I definitely don’t want to cause any issues by participating so I wanted to clarify first. I have lots of opinions about the concept of non-binary, one being that I am inherently non-binary according to colonial logic by virtue of my race/ethnicity/culture (even if I don’t identify with the term itself) to add context

Yes, you are absolutely welcome to participate and I am definitely interested, and it's just a quick and messy survey of silliness so it getting messed up may even be inevitable??

I've got that usual introductory checkbox:

So, "nonbinary" in this case is a catch-all that just means "gender that is not adequately described/encompassed/contained by the restrictive binary model of gender that says you have to be EITHER All Man OR All Woman". If you've been failed by the useless and overly simplistic gender binary, this survey needs YOU 🫵

UK petition: Commit to not amending the Equality Act's definition of sex

It has been reported that the Government may amend the Equality Act to "make it clear that sex means biological sex rather than gender." The Government has previously committed to not remove legal protections for trans people, an already marginalised group, but this change would do so.
Currently, the Act protects trans people from discrimination on the basis of both sex and “gender reassignment”, regardless of whether they have undergone medical transition or hold a Gender Recognition Certificate. It can allow trans people to access single-sex spaces such as DV shelters, bathrooms and hospital wards.
The proposed change would remove a legal protection for trans people and encourage discrimination. We ask the Government to refuse this change to the Equality Act 2010.

As a result of the UK showing its institutional transphobia and stoking the already overblown moral panic, this official parliament petition has gone from 13,000 signatures to over 90,000 signatures in 2.5 days.

You can sign if you live in the UK regardless of citizenship, and if you're a UK citizen regardless of where you live. The deadline is 15th May 2023, which is just over a month from the day I'm posting this.

UK nonbinary legal recognition court case

Ryan Castellucci, who is nonbinary, has issued legal proceedings against the Gender Recognition Panel (GRP) and the Secretary of State for Justice arguing that the GRP breached its statutory duty to issue a Gender Recognition Certificate (GRC) in terms which record Ryan’s acquired gender as nonbinary, and has instead decided to issue a GRC of uncertain legal effect. Ryan is also seeking a declaration that a GRC which records Ryan’s gender as “not specified” would mean that their gender is for all purposes nonbinary.

It turns out that the Gender Recognition Act in the UK doesn't actually specify that you have to be moving from male to female or from female to male, which means there is absolutely already room within the law to allow for nonbinary genders, and obviously the government should accommodate that.

Contribute to the crowdfund here - it's currently at £2,178 pledged of £100,000, with 28 days to go, ending on 27th April 2023.

UK petition: Amend the Gender Recognition Act to allow for posthumous and expedited grants

Amend the Gender Recognition Act (2004) so that:
- Family of a dead trans person with no GRC can apply for a GRC and reissued death certificate via statutory declaration - Where a trans individual has been diagnosed with a terminal illness, they can acquire a GRC via statutory declaration
More details
One of the primary functions of a GRC has to do with dignity in death.
Where a trans individual of any age dies unexpectedly, or is diagnosed with a terminal illness and does not have the time to go through the process, a source of trauma for them and/or their family/friends may be that their death certificate will be in the wrong gender.
Allowing for a process based on statutory declaration in these extenuating circumstances is a small step towards rectifying the indignity of this scenario.

Two important UK-based petitions to sign and/or share

These are official petitions on the UK government/parliament website. You can sign these if you're a UK citizen (living anywhere), or if you're living in the UK (regardless of citizenship).

At 10,000 signatures, these petitions get a response from the government - usually providing crap justifications for why they're not going to do the right thing. At 100,000 signatures, it gets debated in parliament and that goes on the public record, and that can be used in future legislative decisions.

We believe kids should learn about this at an early age. I am sure there are many parents who want their and other children taught about LGBT issues in primary school.
There is a petition to remove this content, which we believe is discriminatory. LGBT people exist, they have the same rights as the rest of us and kids should know them and accept them without judgement or issue. Despite what their parents might believe.

The queerphobic petition has over 185,000 signatures, whereas the good one has under 20,000, as I write this:

The government are being super transphobic, by blocking Scotland's 6-year-debated law to make it easier to live a dignified life as a trans person. This petition opposes that transphobic decision.

I want the Government to reverse their decision to block the Gender Recognition Reform (Scotland) Bill, as this legislation contains important provisions for the LGBT community in Scotland. We are a United Kingdom, and the UK Government should not block devolved legislation.

Gender identity, England and Wales: Census 2021

The national data from the England and Wales census of about 59.5 million people has been released for the question about gender identity, counting the number of trans people in that population.

Summary:

People were asked “Is the gender you identify with the same as your sex registered at birth?”, and had the option of selecting either “Yes”, or selecting “No” and writing in their gender identity.
6% didn’t answer the question.
- 118,000 (0.24%) answered “No” but did not provide a write-in response
- 48,000 (0.10%) identified as a trans man
- 48,000 (0.10%) identified as a trans woman
- 30,000 (0.06%) identified as non-binary
- 18,000 (0.04%) wrote in a different gender identity
A total of 262,000 people (0.5%) answered “No”, indicating that their gender identity was different from their sex registered at birth. Within this group:

That’s as many “nonbinary” and “other” answers combined as trans men or trans women! I’m assuming a lot of the non-cis blank textbox people are nonbinary or similar, too?

It’s also worth mentioning that due to the stigma associated with one’s gender not conforming to societal norms, these statistics are probably a little on the low side.

UK petition: Legally recognise non binary gender identity

Yes, it is time once again for the biannual official UK petition to recognise nonbinary genders in law! (Official UK government petitions only last 6 months.)

You can sign if you’re living in the UK, or a UK citizen living anywhere. If you’re not in the UK but have followers who are, please consider giving this a reblog.

Have non binary be included as an option under the GRP (Gender Recognition Panel)/ GRC (Gender Recognition Certificate), in order to allow those identifying as non binary to be legally recognised as their true gender identity.
Parliament debated this topic on 23 May 2022 and announced that despite public support, there are no plans to amend the Gender Recognition Act 2004. This Government claims that it wants everybody in the UK to feel safe and confident to be themselves. Without legal recognition, non binary individuals are actively discriminated against by our Government. The right to marriage or civil partnership, for example, is unavailable to non binary persons.

The deadline is 13 June 2023.

There are 164 signatures so far, and at 10,000 we get a response from the government, and at 100,000 we get a debate in parliament.

FOI request, DVLA, on Mx

I recently posted with the results of the freedom of information (FOI) request I made to the UK’s HMRC (government tax department), where I learned that around 7,000 people in the UK use the title Mx on their tax records.

Following that, I did two more FOI requests. One is to the DWP, and that one isn’t yet finished. [Edit 2022-09-07: The DWP have confirmed that no Universal Credit records contain the title Mx, and that the Universal Credit application form does not have Mx available as a title option.]

The other was to the DVLA (Driver and Vehicle Licensing Agency), the department that (among other things) issues driving licenses, and that one is now complete. It’s a snapshot of all records on 25 June 2022, and after tidying up the data a little bit, it looks like this:

So that’s 944 people with the title Mx on their DVLA record in the UK.

The 2022 Gender Census is now open!

The ninth annual international gender census, collecting information about the language we use to refer to ourselves and each other, is now open until 13th August 2022.

After the survey is closed I’ll process the results and publish a spreadsheet of the data and a report summarising the main findings. Then anyone can use them for academic or business purposes, self-advocacy, tracking the popularity of language over time, and just feeling like we’re part of a huge and diverse community.

If you think you might have friends and followers who’d be interested, please do reblog this blog post, retweet this tweet, boost this Mastodon post, check out this post on Reddit, and share the survey URL by email or at AFK social groups or on other social networks like Facebook. Every share is extremely helpful - it’s what helped us get 44,000 responses last year.

I've seen some people getting worried about last week's change to privacy laws affecting trans people in the UK, and also some misunderstandings of what's actually happening. This post will explain what's going on and the implications for british trans people.

Some statistics on Mx in the UK

I recently submitted a Freedom of Information request to HMRC (Her Majesty’s Revenue and Customs, they handle taxes in the UK) to find out how many people use various titles.

I had two goals:

  • To find out a minimum number for how many people in the UK are using the title Mx;
  • To find out how the number of people using Mx compares to the number of people using other titles.

HMRC provided data from the two largest sets of data they had: self-assessed tax returns, and PAYE (pay as you earn) tax. (Note that these two sets of data don’t contain everyone in the UK, and a small proportion of people are probably in both sets. HMRC also told me that the “other” category contains typos.)

The blue rows highlight titles that are represented by a greater percentage of people than in the other dataset. So, for example, the title Mr is represented by more people in the self-assessed dataset (60%) than in the PAYE dataset (47%). (This visually helps more when you view the tables side-by-side instead of one and then the other underneath, which is another Tumblr issue.) I did this to see at-a-glance patterns between gender, marital status, and qualifications relating to tax type. Dr, Mr and Mrs are all larger proportions in the self-assessed group compared to PAYE, and I think that may relate not to qualifications or marital status or relative privilege, but to age - as people age they become more likely to have acquired doctorates and spouses, and they also become less likely to pay tax through PAYE.

There were much higher proportions of people claiming the titles Miss, Ms and Mx in the PAYE group.

It seems that there are at least 7,000 people in the UK using the title Mx in a “legal” (tax-related) capacity. In the grand scheme of things this is a very small percentage, but if I imagine a group of 7,000 nonbinary and otherwise genderly interesting people I find it quite heartening! Hello, everyone. :)

(I feel that I should mention at this point that this data is NOT representative of the proportion or number of nonbinary people in the UK.)

I’m sure that as Mx becomes more well-known these numbers will increase. I may request this information from HMRC again at several future dates to see if any rough trends can be identified.

If you’re out there and you’re in the UK and paying tax and your title is Mx and you didn’t know that you can register your title as Mx with HMRC, I hope this serves to inform you that it’s possible.

Edit to add responses:

This is cool. I'd be interested if you could find the info from the DVLA as I'm Mx on my driving licence. Mainly because I requested it myself, when it came to my last employed job my employer didn't even ask me. I said I was a man and they put "Mr" by default, so I feel like there would be more representation in things like driving licence. Just a theory though.

I did consider the DVLA, so yes, I’ll put that on my to-do list!

I think the PAYE data is severely skewed by employers. I'm non binary, AFAB, and my tax is done by a HR department I have neversspoken to, who saw my name and assumed Mr. My preferred is no title, and I definitely never put one on any form. I expect there are a lot of genderqueer people in that situation, or something similar. If your employers HR system only allows an M or F, you would have to shout very loudly at people you don't work with, to get that info updated.

Really good points. I definitely think there are more than 7,000 people who use Mx, and I’d very much encourage people to make sure their title is logged correctly with employers and HMRC.

I'm sure you're familiar with the news from earlier this month (April 2022) that UK Prime Minister Boris Johnson has gone back on his pledge to ban conversion therapy for trans people.

There is now an official UK parliament petition that calls for the government to ban conversion therapy for everyone.

The deadline is 6 October 2022. It has just over 3,000 signatures so far, and it needs 10,000 for a response from the government and 100,000 to be debated in parliament.

UK petition: Recognise LGBTQ+ parents equally on UK birth certificates

Birth certificates should record legal parenthood. Parents need the choice to register according to their legal gender or gender neutrally. The gender neutral 'parent' label should be available to anyone to choose.
Children must be able to know their genetic make-up and who gave birth to them.
This could be made clear or included on the certificate, or recorded separately.
UK birth registration is outdated and discriminatory.
All legal parents, including through surrogacy, must be recognised from conception and allowed to register on their child's birth certificate.
Key issues:
– Only heterosexual, cisgender parents can register accurately as "mother" or "father"
– Children born to transgender parents or through surrogacy have inaccurate birth certificates. Trans parents cannot register as their legal gender but must register as their sex assigned at birth, even if they have a Gender Recognition Certificate and therefore, an updated birth certificate
– The definition of "parent" in the Human Fertilisation and Embryology Act is extremely narrow and gender-specific

Do you know of any UK banks that explicitly support Mx on their backend? I originally joined NatWest as a child because I saw a LJ post about someone getting Mx on their card, but it turns out that was a special request custom title and their computer system cannot store the title, so I'm still in their system as Mr. and I have to constantly get cards and other items re-issued with the correct title. I'm tired of it and I want to move to a bank that stores Mx in their computer system.

Unfortunately I don't personally have any information about the IT systems of banks, but it might be that someone else does and can reply here, so I'll publish this and hope that they see it and respond!
