OPT OUT OF DISCORD'S NEW ARBITRATION CLAUSE
I'm sure many people in the U.S. have seen discord's new terms of service thing pop up today, April 15th 2024, but haven't actually read it. this is an update to make it so you can't sue them or participate in any class actions against them. these kinds of agreements should be illegal and stuff but they aren't so here we are. there's no easy button to click that says opt out. to opt out you have to email their arbitration opt-out email, arbitration-opt-out@discord.com, with the following subject and message:
subject: Opt-out notice
body:
I, (your legal name), decline the agreement to arbitrate in Discord's Terms of Service updated March 15, 2024 for any and all accounts I have or use, past and present, and those that I create, have, or use in the future, regardless of their association with this email.
Please acknowledge your receipt of this opt-out notice in writing by replying to this email.
(your legal name)
Caveats to be noted, because I wanted to read the TOS to verify (written April 17th 2024):
- In all situations, you agree to attempt to talk to Discord before taking a matter to arbitration or a lawsuit.
- In the US, you are agreeing to arbitration and forfeiting your legal right to court action as a starting point.
- In the US, in cases of "mass filings" (30 or more similar arbitration demands), they'll be grouped together and dealt with by one arbitrator. Once they come to a decision you are able to opt out of the arbitration process and take the matter elsewhere.
- In the US, you are entirely and completely waiving your right to a jury trial in favour of arbitration "to the maximum extent permitted by law".
- US residents are still able to bring Discord to small claims court exclusively in San Francisco County, California.
- You are able to opt out of the arbitration agreement within 30 days of April 15th 2024 or 30 days from when you first create the account.
- If you opt out, you are also allowing Discord to opt out of the arbitration process.
This is shitty. Heads up to all my US friends!
This doesn't apply outside the US, btw. Seems SUPER sketch.

Also note that some processes aren't subject to this arbitration thing:
