Alabama Abortion Bill Masterpost

Today (Wednesday, May 15, 2019), the governor of Alabama signed into law the Alabama Human Life Protection Act (THAT’S THE FULL TEXT OF THE BILL GO READ IT). 

  • This bill prohibits all abortion, making abortion a class A felony and attempted abortion a class C felony.
  • Women who have an abortion “will not be held criminally culpable or civilly liable for receiving the abortion” (page 1, lines 6-8)
  • An exception is made if abortion is necessary to “prevent a serious health risk to the unborn child’s mother.” (page 1, lines 4-6)
  • This bill does not prevent doctors from protecting the child or the mother’s health, removing a unborn child who has died, delivering prematurely to protect the child and/or the mother, treating an ectopic pregnancy, or removing a child who is dying or would likely die shortly after birth*. (page 4, lines 16-25)
  • Unlike most other pro-life bills that have been passed in recent years, this one has no exception for pregnancies caused by rape or incest. This is a good thing, as children conceived in rape are no less human or valuable than those conceived in love. 

*Exceptions that allow for the abortion of children who would die shortly after birth are not consistent with pro-life goals. We know that doctors have been mistaken and children who were not supposed to survive have grown up to live healthy, happy lives. In the case where a child has a medical condition or disability that may prove fatal, that child should be given every opportunity to live the life they have, rather than having that life intentionally cut short.
