Shepard Fairey and The Associated Press Announce Agreement in Obama HOPE Poster Case

The Associated Press, Shepard Fairey and Mr. Fairey’s companies Obey Giant Art, Inc., Obey Giant LLC, and Studio Number One, Inc., have agreed in principle to settle their pending copyright infringement lawsuit over rights in the Obama Hope poster and related merchandise. 

Mr. Fairey used an AP portrait photograph of Mr. Obama in making the Hope poster. Mr. Fairey did not license the photograph from the AP before using it. The AP contended that Mr. Fairey copied all of the original, creative expression in the AP’s photograph without crediting or compensating the AP, and that Mr. Fairey’s unlicensed use of the photograph was not a fair use. Mr. Fairey claimed that he did not appropriate any copyrightable material from the AP’s photo, and that, in any event, his use of the photograph constituted a fair use under copyright law.

In settling the lawsuit, the AP and Mr. Fairey have agreed that neither side surrenders its view of the law. Mr. Fairey has agreed that he will not use another AP photo in his work without obtaining a license from the AP. The two sides have also agreed to work together going forward with the Hope image and share the rights to make the posters and merchandise bearing the Hope image and to collaborate on a series of images that Fairey will create based on AP photographs. The parties have agreed to additional financial terms that will remain confidential. 

Fair Witchhunt for Muslim Promised

So it certainly seems a lot of general statements of suspicion are being made before the Investigation even starts. Honestly, maybe it is Extremist Zionism that is causing the problems. How about a hearing on that? — And Crazy Christians who appear eager to rush towards their Second Coming and Apocalypse and want to control personal behavior of everybody on planet Earth are another fascism force in our society. — I know such statements may seem ‘radical,’ to some but these forces swirl around us daily, like storm clouds and this Congressional Investigation of a religion is symptomatic of how worse it’s getting. Judaism and Christianity are as equally full of calls for war (and genocide) as any other religion and the words of Jesus about ‘look at yourself,’ before you start casting stones at others are good. The One Commandment of Jesus about treating others like how you’d like to be treated might be good for these Fanatic Fascist Christians to remember and return to. Of course…it’s all about the Oil (and expanding Israel) so any words that can be said to help that are said, any flags that can be thrown in our face are thrown, any false ideals to wave are waved, this Ship of Fools has long set sail. (Voting for better, non-warmongering leaders still a good idea).

The Associated Press is warning its writers against retweeting posts on Twitter in a way that may indicate their personal opinion. Jeff Sonderman, from the Poynter Institute, suggests that journalists begin using a new form of shorthand to indicate a “neutral tweet.”

More Death in Libya

The loyalists of Moammar Gaddafi are slowly retreating, though not without causing problems. It’s being reported by survivors and Human rights groups Sunday that the loyalist’s of the president killed scores of detainees and shot civilians over this past week while the rebel forces take control of the Libyan capital.

The New York based Human Rights Watch said that the evidence they have collected “strongly suggests that the Gaddafi government forces went on a sort of killing spree as Tripoli was falling.” Mohammad al-Algi, the Justice minister in the rebels temporary government, said that all of the allegations would be investigated thoroughly and the leaders of Gaddafi’s military will be put on trial.

There have been no pin pointed allegations of the crimes carried out by the rebel fighters, human rights groups are continuing the investigations of some of the unsolved cases

Associated Press reporters have witnessed several of the episodes of the rebels mistreating its detainees, and the Saharan Africans suspected of being hired as Gaddafi’s gunman.

The Health Minister, Najib Barakat, for the rebels government said on Sunday that he had yet to receive an official death toll for the week-long battle over the country’s capital.

Barakat has said that efforts are being made to identify the bodies being retrieved from the streets and are being photographed before burial to allow future identification for relatives.

Gaddafi supporters fired rockets at the rebel forces that gathered in the town of Nawfaliyah late Sunday.

The rebels gave all of the residents in the city ten days to allow the rebel forces in peacefully or they would face assault.

Tuesday over 120 prisoners were held in a hangar, when soldiers told that they would be released only to have hand grenades hurled inside. Gunfire followed to take care of anyone that survived. Three people were badly wounded, but made it out alive. Similar stories of this type of massacre are being reported all over the city.

Wednesday saw guards at a Gaddafi military base in the suburbs of Tripoli shooting and killing five of the prisoners held in solitary confinement, Amnesty International said, citing the survivors. Other detainees panicked and broke out of their cells when they heard the shots, survivors said. By that time, the guards had fled.

In addition to the killings at detention centers, Human Rights Watch said it collected testimony about Gadhafi soldiers randomly shooting civilians. In one incident, on Wednesday, medical lab technician Salah Kikli said he saw Gadhafi fighters pull two unarmed men, including one in medical scrubs, from an ambulance and kill them.

Reporters saw bodies in advanced stages of decomposition at Abu Salim hospital, including in the parking lot, a ward and in the basement. Barakat, the health minister, said a total of 75 corpses were found at the hospital.

Another group of bodies was strewn across a roundabout near Bab al-Aziziya, Gadhafi’s compound. Five were in a field clinic, housed in a tent, and one of the corpses still had an IV sticking in his right arm.

Human Rights Watch counted a total of 29 bodies in that area, where Gadhafi loyalists, many from sub-Saharan Africa, had camped out in recent months. The group said it was not yet clear who was responsible for the deaths.

Some rebel fighters have mistreated detainees, pushing or hitting them, though others have tried to stop abuse. In many cases, wounded rebels and regime fighters were treated side-by-side in rebel-controlled hospitals.

On Sunday, in a neighborhood on the outskirts of the city, rebels apprehended a dozen black men and accused them of being mercenaries in Gadhafi’s army. The detainees were occasionally punched before one of the rebels convinced his comrades the men were just migrant workers.

Concoct a crappy story about the violence not being directed against the U.S. but caused but some “film desecrating Muhammad”. Have you heard of anyone who has claimed to have seen this “film” ? No? Not even the Obama Media ?? Yet the Obama Ambassador to the U.N. claimed on two different talk shows yesterday  ”..it was widely viewed all across ‘The Region’.” And also that the kindly citizens carried the Ambassador to the hospital. What a crock!

Oh, and that crack FBI Investigation Team sent to Benghazi to “find the culprits” - they beat feet and “left as it was too dangerous for Americans there”. Even though they had ammo for their weapons unlike the Marine Guards at the embassy in Cairo who had NO AMMO as ordered by the U.S. Ambassador there. What a bunch of idiots !!

TRIPOLI, Libya — The American ambassador to Libya and three other Americans were killed when a mob of protesters and gunmen overwhelmed the U.S. Consulate in Benghazi, setting fire to it in outrage over a film that ridicules Islam’s Prophet Muhammad. Libya’s new president apologized Wednesday for the attack, which underlined the lawlessness plaguing a region trying to recover from months of upheaval.
Ambassador Chris Stevens, 52, died as he and a group of embassy employees went to the consulate to try to evacuate staff as a crowd of hundreds attacked the consulate Tuesday evening, many of them firing machine-guns and rocket-propelled grenades.
By the end of the assault, much of the building was burned out and trashed. Stevens was the first U.S. ambassador to be killed in the line of duty since 1979.
A Libyan doctor who treated Stevens said he died of severe asphyxiation, apparently from smoke. In a sign of the chaos of during the attack, Stevens was brought alone by Libyans to the Benghazi Medical Center with no other Americans, and no one at the facility knew who he was, the doctor, Ziad Abu Zeid, told The Associated Press.
Stevens was practically dead when he arrived close to 1 a.m. on Wednesday, but “we tried to revive him for an hour and a half but with no success,” Abu Zeid said. The ambassador had bleeding in his stomach because of the asphyxiation but no other injuries, he said.
President Barack Obama ordered increased security to protect American diplomatic personnel around world. Hours before the Benghazi attack, Egyptians angry over the film protested at the U.S. Embassy in Cairo, climbing its walls and tearing down an American flag, which they replaced briefly with a black, Islamist flag.
“I strongly condemn the outrageous attack on our diplomatic facility in Benghazi,”Obama said, adding the four Americans “exemplified America’s commitment to freedom, justice, and partnership with nations and people around the globe.”
