Judge tells trans person’s neighbor to pay up for years of harassment and hate comments
lexiecannes.wordpress.comAmong other things, the trans person’s neighbor, Wilna van Staden, would call her neighbor “it”, routinely tell people of the trans person’s gender change, circulated a petition to get the trans person evicted, and invited visitors to watch her trans neighbor over the bordering fence.
After complaints to the housing management and the police failed to curtail the neighbor’s harassment, the trans person’s attorney took van Staden to court.
Earlier this year South African Magistrate M J Thobela ruled van Staden’s behavior amounted to unfair discrimination and hate speech. Thobela ordered van Staden to pay damage for moving expenses, for the pain, suffering and humiliation she endured as well as counseling expenses. Thobela cited the Promotion of Equality and Prevention of Unfair Discrimination Act of 2000 as the basis for the decision.
The trans person’s attorney Michal Johnson: “People have been allowed to say what they wanted to vulnerable groups of our society for far too long without suffering the consequences. The ruling sent out a clear message that the act afforded protection to victims of hate speech and that the courts would enforce their constitutional rights.”

“Students at the University of California, Santa Cruz are circulating a petition calling on the office of the university president to condemn shocking, inciteful hate speech and virulently racist assumptions by a UCSC lecturer against students involved in Palestine solidarity activism on campus.
The lecturer, Tammi Rossman-Benjamin, is a well-known anti-Palestinian racist and inciter of accusations against students and professors who criticize Israeli policies. A video of a speech she gave at a synagogue on 20 June 2012 has surfaced, in which Rossman-Benjamin claims that students “have become poisoned by the rhetoric they hear on campus,” ostensibly referring to Palestine-related activism and criticism of Israel’s policies against Palestinians.
“And who are the primary sources of this?” she asks in the video. “Primarily the MSA [Muslim Student Association] and the SJP [Students for Justice in Palestine] students … they are generally motivated by very strong religious and political convictions, they have a fire in their belly, they come to the university, many of them are foreign students who come from countries and cultures where anti-Semitism is how they think about the world … These are not your ordinary student groups like College Republicans or Young Democrats. These are students who come with a serious agenda, who have ties to terrorist organizations.”
Sometimes I wonder if the people defending supporters of hate groups like the Family Research Council would be as quick to defend backers of other, more widely recognized hate groups. Like, if you’d hear the same lines of reasoning in their defense. Arguments like “I am 100% in support of Jewish rights but it is completely wrong to bag on a guy for backing the Aryan brotherhood” or “even if they did donate money to the KKK, it’s not like they told them to use it to buy crosses for burning on people’s lawns!”
I just wonder if the kind of people who say “_____ is great but I support your right to be dangerously intolerant of it” extend that same kind of freedom from social responsibility to all forms of hate speech and bigotry. Freedom of speech protects you from legal consequence, it does not protect you from being told your opinions are shitty and you should be ashamed of them.
I’m sure people will say it’s a hyperbole to compare the FRC to the KKK, but we’re talking about a group who lobbied against pressuring another country to throw out proposed legislation that would allow them to execute homosexuals, and that’s only one item in their laundry list of intolerance.
I dunno, just something that’s been on my mind lately.
